What is the difference between sealing and expungement?
Both sealing and expungement prevent the general public from accessing a criminal history record. Expungement involves destroying the records, with only one copy retained by the Department of Law Enforcement and the court. On the other hand, sealing hides the records from public view, but they can still be accessed by the subject of the record or their attorney.
How many arrests can I have sealed or expunged?
Under Florida law, you can typically only have the criminal history record from a single arrest sealed or expunged. However, if a court determines that multiple arrests are directly related, it has the authority to order the sealing or expungement of the records from those related arrests.
Expunctions
$375 (not including mandatory $75.00 FDLE fee)
An expunction is the legal process of erasing or removing an arrest or conviction from a person’s public criminal record. This means the record is treated as though it never existed, helping individuals avoid the negative consequences of having a criminal record, such as difficulties in finding employment or housing. At Encompass Pro Se, we offer services to assist with the expunction process, helping you achieve a fresh start.
How long does the FDLE process take?
The process can take up to six months, or even longer if the application is incomplete. You can check the FDLE website to see the current month’s applications being processed.
Who Provides the Notice of Order to Seal a Record?
The court clerk is responsible for sending certified copies of the order to seal a record to the State Attorney’s Office and the arresting agency. The arresting agency must then forward a certified copy of the court order to all agencies that received the criminal history information from them.
What offenses can be expunged?
Expungement is possible when no charges were filed, or if all charges from an arrest were dismissed before trial. Additionally, in cases of deferred judgments, a record that has been sealed for 10 years becomes eligible for expungement.
What offenses can be sealed?
Sealing is possible for cases where there has been no adjudication of guilt or where adjudication has been withheld. However, certain serious sexual and violent offenses are not eligible for sealing in cases where adjudication has been withheld.
